Terms of Use

This is a translation for reference purposes. The Japanese version is the legally binding document.

1. Acceptance of Terms

By downloading, installing, or using any application ("Apps") developed by Inutile ("we," "us," or "our"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Apps.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Apps for personal, non-commercial purposes, subject to these Terms and the Apple Media Services Terms and Conditions.

3. Restrictions

You agree not to:

• Reverse engineer, decompile, or disassemble the Apps
• Modify, adapt, or create derivative works based on the Apps
• Use the Apps for any unlawful purpose
• Remove or alter any proprietary notices in the Apps

4. Intellectual Property

All content, features, and functionality of the Apps are owned by Inutile and are protected by copyright, trademark, and other intellectual property laws.

5. Disclaimer of Warranties

THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Apps will be uninterrupted, error-free, or free of viruses or other harmful components.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL INUTILE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Apps
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any bugs, viruses, or other harmful code that may be transmitted through the Apps
• Any errors or omissions in any content

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP, OR $100 USD, WHICHEVER IS LESS.

7. Indemnification

You agree to indemnify, defend, and hold harmless Inutile from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your use of the Apps or violation of these Terms.

8. Right to Refuse Service

We reserve the right to refuse or discontinue service to anyone, at any time, for any reason, at our sole discretion. This includes, but is not limited to, use of the Apps for unintended purposes or abuse of our services.

9. Termination

We may terminate or suspend your access to the Apps at any time, without prior notice, for any reason. Upon termination, your right to use the Apps will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Tokyo, Japan.

11. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page. Continued use of the Apps after changes constitutes acceptance of the revised Terms.
